Terms and Conditions of Sale

1. Preamble
These terms and conditions of sale apply exclusively between the company BHM EXPORT, a SARL with share capital of 60,000 euros, Paris Trade Register 819 429 200, whose registered office is at 82 rue Manin, 75019 Paris (hereinafter ‘We’), and any person making a purchase via the website www.artdeluxe-naturel.com (hereinafter ‘the Customer’).
2. Purpose
These terms define the conditions of sale between BHM EXPORT and the Customer, from order to delivery, including payment, withdrawal and warranties.
3. Orders
Orders are placed exclusively on www.artdeluxe-naturel.com. The process includes the selection of products, validation of the cart, identification, choice of delivery method and payment. Before final validation, the Customer is given a summary allowing them to check and correct their order.
4. Prices
Prices are shown in euros, all taxes included, excluding delivery charges which are stated separately before the order is validated. BHM EXPORT reserves the right to change its prices at any time, it being understood that the applicable price is the one in force at the time of the order.
5. Payment
Payment is due immediately upon ordering. Settlement is made by bank card or by any other method offered on the site. Transactions are secure and bank details are never stored by BHM EXPORT.
6. Delivery
Products are delivered to the address indicated by the Customer when ordering. Estimated times are 3 to 5 working days, in mainland France as well as internationally.
In accordance with article L.216-1 of the French Consumer Code, delivery takes place in any event within a maximum period of thirty (30) days from the conclusion of the contract. Failing this, the Customer may terminate the contract under the conditions set out in articles L.216-2 et seq. and obtain a refund of the sums paid.
7. Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a statutory withdrawal period of fourteen (14) days from receipt of the products, without having to give reasons or incur any penalty.
To exercise this right, the Customer notifies their decision by an unambiguous statement, by email to contact@artdeluxe-naturel.com or by post to BHM EXPORT, 82 rue Manin, 75019 Paris. They may use the model form set out in article 8 below, though this is not compulsory.
Products must be returned in their original packaging, unopened, unused and in perfect resalable condition, within fourteen (14) days of the notification. Return costs are borne by the Customer, in accordance with Article L.221-23 of the French Consumer Code: the Customer bears the direct cost of returning the products. The outbound delivery charges they paid are refunded on the basis of the standard rate, in accordance with Article L.221-24.
7.1 Exceptions to the right of withdrawal
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal may not be exercised for:
- goods liable to deteriorate or expire rapidly (4°);
- goods unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection (5°) — which notably covers our cosmetics and foodstuffs whose packaging or seal has been opened;
- goods made to the Customer's specifications or clearly personalized (3°).
These exceptions are laid down by law and are brought to the Customer's attention before the contract is concluded.

9. Refund
Where the right of withdrawal is exercised, BHM EXPORT refunds all sums paid, including standard delivery costs, at the latest fourteen (14) days from the date on which it is informed of the decision to withdraw. In accordance with article L.221-24, the refund may be deferred until the products are recovered or until the Customer has provided proof of their dispatch, whichever occurs first.
The refund is made by the same means of payment as that used for the order, unless the Customer expressly agrees to another method.
10. Statutory Warranties
All our products benefit as of right, and at no extra cost, from the following statutory warranties:
- The statutory warranty of conformity (articles L.217-3 et seq. of the French Consumer Code), for a period of two (2) years from delivery of the goods. The Customer may request that conformity be restored by repair or replacement or, failing that, a price reduction or termination of the contract. They are exempt from proving the existence of the defect during the twenty-four (24) months following delivery.
- The warranty against hidden defects (articles 1641 et seq. of the French Civil Code), allowing the sale to be rescinded or the price reduced, within two years of the discovery of the defect.

11. Personal Data
The data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR). The purposes, legal bases, retention periods and means of exercising your rights are detailed in our Privacy Policy.
12. Disputes and Governing Law
These terms are governed by French law. In the event of a dispute, the Customer should first contact our customer service to seek an amicable solution.
13. Consumer Mediation
In accordance with articles L.612-1 et seq. of the French Consumer Code, a consumer Customer may refer the matter free of charge to a consumer mediator with a view to the amicable resolution of a dispute not settled with our customer service:

The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. Recourse to mediation is optional and the Customer retains the right to bring proceedings before the competent courts at any time.
14. Orders Outside the European Union
Orders delivered outside the European Union are invoiced without French VAT. They may be subject to customs duties, local taxes and clearance fees levied by the destination country, set by the local authorities and payable by the recipient, usually on delivery. These amounts are not collected by the company and are additional to the price paid on the site.
The fourteen-day right of withdrawal provided for by articles L.221-18 et seq. of the French Consumer Code applies to consumers within the European Union. For orders delivered outside the Union, the return conditions and import rules are set out on the Shipping & Customs page.
15. Amendments to These Terms
BHM EXPORT reserves the right to amend these terms at any time. The applicable version is the one in force on the site on the date of the order.
